Agreement

These Terms govern your use of MailTrail, a Chrome extension and web dashboard for running A/B tests on emails you send from your own Gmail account. By installing the extension or signing in to the dashboard, you agree to these Terms. If you do not agree, do not use MailTrail.

Your account

You sign in with Google. You are responsible for the security of your Google account and for all activity performed through your MailTrail account. You must be at least 18 years old, or the age of majority in your jurisdiction, to use MailTrail.

How sending works

MailTrail sends messages through the Gmail API using the gmail.send scope, only when you explicitly click send. MailTrail does not read, list, or modify your mailbox. You remain the sender of every message and are solely responsible for its content and its recipients.

Acceptable use

  • Do not send unsolicited bulk email, spam, or messages to purchased lists.
  • Comply with all applicable law, including CAN-SPAM, GDPR, and similar anti-spam and privacy regulations, and honor unsubscribe requests.
  • Do not send phishing, malware, deceptive, harassing, or otherwise unlawful content.
  • Do not impersonate another person or organization.
  • Do not attempt to circumvent usage limits, reverse engineer the service, or disrupt its infrastructure.

You must also comply with Gmail's own sending limits and program policies. We may suspend or terminate accounts that violate these rules.

Tracking

MailTrail records email opens using a tracking pixel and clicks using redirect links that you choose to add to your campaigns. You are responsible for disclosing this tracking to your recipients where the law requires it. Open and click data is inherently approximate and may be affected by image proxies, privacy protections, and email client behavior.

Free tier and limits

MailTrail is currently offered free of charge, subject to fair-use limits shown in the dashboard. We may change these limits, introduce paid plans, or discontinue features at any time. We will make reasonable efforts to give notice of material changes.

Your content

You retain all rights to the email content, variants, and recipient lists you provide. You grant MailTrail a limited license to store and process that content solely to operate the service for you. You represent that you have the right to send to the addresses you upload.

Availability and disclaimer

MailTrail is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted service, message delivery, or the accuracy of any metric.

Limitation of liability

To the maximum extent permitted by law, MailTrail and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, nor for lost profits, revenue, data, or goodwill arising from your use of the service. Our total aggregate liability will not exceed the greater of the amount you paid us in the twelve months preceding the claim, or USD 100.

Termination

You may stop using MailTrail at any time by removing the extension and revoking its Google access from your Google Account settings. We may suspend or terminate access for violations of these Terms. On termination you may request deletion of your data as described in the Privacy Policy.

Changes to these Terms

We may update these Terms from time to time. Continued use after an update constitutes acceptance of the revised Terms. The "Last updated" date above reflects the current version.
